TekSavvy receives request for customer information in alleged Customer Copyright Infringement

December 10th, 2012. Chatham, Ontario. 

TekSavvy Solutions Inc. has received a motion from Voltage Pictures LLC asking the Federal Court of Canada to order TekSavvy to provide the names and contact information of customers associated with certain IP addresses that are alleged to have engaged in copyright infringement.  This request comes weeks after the Copyright Modernization Act was implemented in Canada.  This request is, to TekSavvy’s knowledge, the largest of its kind in Canada.

TekSavvy has a responsibility to protect its customer information and is committed to protecting customer privacy.   TekSavvy is also obligated to co-operate with the courts in copyright infringement cases, and will provide information if required to do so by a court order.

TekSavvy believes in transparency and that customers have the right to privacy, and to know that their information is being requested from an outside source.  TekSavvy has therefore insisted that Voltage give it the opportunity to advise affected customers of Voltage’s motion.  Some TekSavvy customers have already received a communication from TekSavvy that a 3rd party request has been made for their personal information.

“Currently we have not received a court order, only a request for information and a motion for an order.  We will not provide the information until we are ordered to by a court.   This is unknown territory for Canadians.  We have retained legal counsel to help us through the process and ascertain our rights and obligations as an ISP.  If you are caught up in one of these actions, you may wish to seek legal advice respecting your own rights.” says Marc Gaudrault, CEO of TekSavvy.
